Welcome to Border Haul (“we,” “our,” “us”). These Terms of Use (“Terms”) govern your access to and use of the Border Haul website, mobile apps, and related services (“Platform”). By creating an account or using the Platform, you agree to these Terms.
If you do not agree, do not use Border Haul.

1. Definitions

  • “Platform” – Border Haul’s technology platform, mobile app, load board, and related tools.

  • “User” – Any person or entity using the Platform.

    • “Shipper” – A user posting or requesting freight transportation.

    • “Carrier” – A motor carrier, owner-operator, or driver providing transportation services.

  • “Load” – A shipment posted through the Platform.

“Services” – Technology services, brokerage services (when applicable), communication tools, compliance tools, and payment processing.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old

  • Have the legal authority to enter into binding agreements

  • If you are a carrier: hold valid FMCSA authority, insurance, safety documentation, and compliance credentials

We may verify identity and compliance using third-party providers (e.g., Stripe, FMCSA databases, customs agencies).

3. Border Haul Technology Platform (“Platform Services”)

Border Haul provides a digital system that allows shippers and carriers to:

  • Post and accept loads

  • Exchange messages

  • Upload documents (including customs and compliance docs)

  • Track shipments

  • Process payments

For standard platform transactions, Border Haul is NOT a carrier and NOT a broker.
The agreement is strictly between the shipper and the carrier.

4. Marketplace Loads 

Marketplace Loads occur when:

  • Shippers post loads directly, and

  • Carriers accept them directly through the Platform.

For these loads:

  • The contract is between Shipper and Carrier only

  • Border Haul is not a party to the transportation contract

  • Border Haul is not liable for freight, delay, loss, or customs penalties

  • Users are responsible for confirming load details, documentation, and compliance

Marketplace Loads are typical for most Platform transactions.

5. User Responsibilities

5.1 Accuracy of Information

Users agree to provide truthful and complete information, including:

  • Business and contact details

  • Carrier authority, insurance, and vehicle info

  • Customs/export/import documentation

  • Pickup/delivery information

5.2 Legal Compliance

Users must comply with all laws and regulations, including:

  • FMCSA rules

  • USDOT requirements

  • CBP/SAT cross-border regulations

  • In-bond regulations

  • Safety and insurance standards

5.3 Prohibited Actions

Users may not:

  • Provide false information or forged documents

  • Circumvent platform fees

  • Misuse or tamper with the Platform

  • Fail to pay for services rendered

  • Accept loads they are unable or unauthorized to complete

  • Harass or threaten other users

  • Transport illegal or unauthorized goods

6. Payments

Border Haul uses Stripe Connect for secure payment processing.

6.1 Shippers

You authorize Border Haul and Stripe to:

  • Charge your credit card or bank account, or pay by invoice

  • Place holds or authorizations

  • Apply platform fees

  • Release or withhold funds in case of disputes or compliance concerns

6.2 Carriers

Carriers are paid via Stripe Connect payouts, minus:

  • Platform fees

  • Broker fees (when applicable)

  • Adjustments for disputes, claims, or fraud reviews

Border Haul does not store full banking or card information.

7. Load Agreements

The agreement is directly between Shipper and Carrier.
Border Haul is not responsible for:

  • Delivery performance

  • Cargo loss or damage

  • Delays, storage fees, or customs penalties

8. Ratings & Reviews

Users may leave reviews about each other.
By posting feedback, you grant Border Haul a license to display this content.
False or defamatory reviews may be removed.

9. Intellectual Property

All technology, software, content, and branding on the Platform belong to Border Haul.
Users may not copy, distribute, reverse-engineer, or commercially exploit the Platform.

10. Termination

We may suspend or terminate accounts for:

  • Safety or compliance violations

  • Misuse of the Platform

  • Non-payment

  • Illegal activity

  • Fraudulent documents

  • Violation of these Terms

Users may close their account at any time by contacting support.

11. Disclaimers

The Platform is provided “as is” and “as available.”
Border Haul does not guarantee continuous service, load availability, or carrier/shipper performance.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Border Haul is not liable for indirect, incidental, special, or consequential damages

  • For Marketplace Loads, Border Haul’s liability is zero, since it is not a party to the freight contract

13. Indemnification

Users agree to indemnify and hold Border Haul harmless from claims resulting from:

  • User violation of laws

  • Customs, import/export, or transportation penalties

  • Cargo loss or delay

  • Platform misuse

  • Personal or property injury caused during transportation

  • Any breach of these Terms

14. Governing Law

These Terms are governed by the laws of the State of Texas.
Disputes will be handled in courts located in Webb County, Texas, unless both parties agree to arbitration or mediation.

15. Changes to Terms

We may update these Terms at any time.
Continued use of the Platform means you accept the updated Terms.
