Welcome to BorderHaul. These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Services”). By accessing or using BorderHaul, you agree to these Terms. If you do not agree, you may not use our Services.
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use our Services. By using BorderHaul, you represent and warrant that you meet these requirements.
2. Accounts and Verification
To access certain features, including shipper, carrier/transfer, and driver functions, you must create an account.
You agree to provide accurate and up-to-date information during registration and keep your account information secure.
BorderHaul may send verification codes via SMS to confirm your identity and secure account access. By creating an account, you consent to receive these one-time messages.
Verification codes are for your personal use only. Do not share them with anyone.
3. Acceptable Use
You agree not to:
Use the Services for any unlawful, fraudulent, or unauthorized purpose.
Interfere with or disrupt the security, integrity, or performance of the Services.
Attempt to gain unauthorized access to any account, system, or network connected to BorderHaul.
4. Messaging and Communication
BorderHaul may send you transactional messages (such as booking confirmations, shipment updates, or verification codes).
These messages are not marketing communications.
Standard messaging and data rates may apply.
You may not opt out of essential transactional messages while maintaining an active account.
5. Shippers’ Terms
If you are a shipper using BorderHaul:
You agree to provide accurate shipment information, including pickup and delivery details, commodity descriptions, and any special handling instructions.
You are responsible for ensuring that all goods are properly packaged, labeled, and compliant with applicable laws and regulations.
You must pay all shipping charges, fees, and surcharges as outlined at the time of booking.
You acknowledge that carriers are independent contractors and not employees or agents of BorderHaul. BorderHaul is not liable for delays, losses, or damages caused by carriers.
Once a shipment is booked, cancellations or changes may be subject to fees.
You agree not to tender hazardous, illegal, or restricted goods without full disclosure and proper documentation.
6. Carriers/Transfers’ Terms
If you are a carrier or transfer company using BorderHaul:
You agree to maintain all required licenses, permits, and insurance necessary to operate lawfully.
You are responsible for ensuring your drivers comply with all transportation and safety regulations.
You must accurately update shipment status within the platform, including pickup, border-crossing, and delivery milestones.
You agree to transport goods with reasonable care and in compliance with all applicable laws.
You must not subcontract shipments without prior approval, unless permitted by the shipper and BorderHaul policies.
Payments for completed shipments are disbursed in accordance with BorderHaul’s payout schedules and rules.
7. Drivers’ Terms
If you are a driver using BorderHaul through a carrier/transfer account:
You must hold a valid driver’s license and comply with all driving, safety, and cross-border regulations.
You may be required to present proof of documents (permits, customs paperwork, etc.) before pickup or delivery.
You agree to update your trip status in the BorderHaul app, including arrival, pickup, border crossing, and delivery events.
You may receive verification codes and one-time passcodes via SMS for account security and shipment updates.
You are prohibited from misusing the app to falsify delivery status or upload fraudulent Proof of Delivery (POD) documents.
8. Payments
Payments between shippers, carriers, and drivers are facilitated through third-party processors (e.g., Stripe).
BorderHaul does not store your payment information.
All financial transactions are subject to the terms and conditions of the payment processor.
9. Intellectual Property
All content, trademarks, logos, and software associated with BorderHaul are owned by or licensed to us. You may not copy, modify, or distribute our content without prior written permission.
10. Termination
We may suspend or terminate your account at our sole discretion if you violate these Terms or misuse the Services.
11. Disclaimer and Limitation of Liability
BorderHaul provides the Services “as is” and without warranties of any kind.
We are not responsible for delays, losses, or damages arising from shipments, third-party carriers, drivers, or other users of the platform.
To the maximum extent permitted by law, BorderHaul’s liability is limited to the amount you paid (if any) for use of the Services during the twelve (12) months prior to the claim.
12. Indemnification
You agree to indemnify and hold BorderHaul harmless from any claims, damages, losses, or expenses resulting from your use of the Services or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of [Insert State, e.g., Texas or Delaware], without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Services after changes means you accept the revised Terms.
